To answer your question--
We decided to use torture (and in various other ways shred the U.S. Constitution) because we are fukkin' COWARDS. We were so successfully terrorized that we decided to surrender the values that make different from the terrorists.

Once again, we are letting Dick and the GOP frame the debate, pick the battlefield. And it's getting really old.
I don't think there are a handful of Americans out there that really give a hoot in hell whether or not Mr. Pantie Bomber Dude has his nut sack wired to 220 or not. It's not as if his guilt or innocence is in question. Dude, your panties were on fire. Dude, you had your dong wrapped in C4. That's some kind of fetish you have there, partner.
The problem is we are treating this guy (and a lot of other bona-fide terrorists) like he took a 5-finger discount at a 7-11 or something.
And every time we try to make that argument, we lose. Big.
All that being said, however, I do realize the slippery slope with the Jack Bauer nut-sack grilling crowd. Today terrorists, tomorrow those who may be up to something, the next day those who may be, kinda sorta, thinking about maybe being up to something.
I still think that the panties dude is the absolute wrong person to parade around as if we are the civilized nation.
Compromise? Fry the panties guy at Gitmo. Be civilized with the douche bag sheik (his guilt or innocence is less clear cut).
Of course, I am in a terrible mood today, so I'll probably think differently in the morning!
